For those who’re concerned about ODEX’s legal threats, do know that the company isn’t standing on firm legal grounds. The recent news such as this would give those who’d been ODEXed some hope: “Anime case: Odex had ‘no right of civil action’” (Today Online). The recent ruling on the ODEX-PacNet case shed some light on ODEX’s legal position. In the Straits Times article “Odex-PacNet ruling may set online privacy precedent“, District Judge Ernest Lau who presided over the hearing, arrived at his judgment for denying ODEX access to PacNet’s subscribers’ identities based on two reasonings:

* The draconian and drastic consequences of such an order upon the receiving party; ie, thus, an extremely strong standard of proof would be required for such an order in a civil case.

* A proper action for copyright infringement should be brought directly by the Japanese anime studios or the EXCLUSIVE LICENSEE. Odex is a sub-licensee but Odex is NEITHER the copyright owner nor EXCLUSIVE LICENSEE of the anime titles.

Skywander who posted the thread “Odex owned you; time to own Odex back :)” on Hardwarezone’s Eat-Drink-Man-Woman section brought attention to the statute on “Groundless threats of legal proceedings“. That could work in favour of those who received the threatening letters from ODEX.

The cybersleuths on Hardwarezone’s EDMW sub-community managed to dig up more dirt on ODEX’s past. Some one had done a look up an ACRA, and stumbled upon the Games Mart scandal. The current partners of ODEX formerly had a hand in Games Mart. This company was shut down after it was busted for selling pirated products.

Many of the local anime fans and otakus feel that the quality of ODEX’s products, even though licensed, are no better than the kind of pirated anime VCD that Games Mart sold. So we should treat ODEX’s products like how we treat pirated videos:

This could have been one of the most Foolish thing that I’ve done.

I went ahead with the People’s Action Figure Party photoshoot, not knowing who will turn up or what to expect.

Some anti-ODEXists came and contributed their action figures for the photoshoot. Thanks, for all those who contributed and helped (Joo Khai, Zaric + friend, Psyke, Pp + friend, sesshomaru_haku, Cuz). Thanks! You guys made this photoshoot possible.

Also present were those who burnt their weekend to keep the peace. I salute them.

p.s. I have a lot of thoughts regarding this episode that happened. Shall leave that for another entry. Have to sleep now. The morning call is at 0330hrs.

  50. @yallo: yeah, it’s hebrew. I’ve been reading here for quite some time, ever since tsubaki of Anime Desho Desho wrote about this blog. This blog actually got me into a bit of tokusatsu, although so far I’ve only watched Kamen Rider Kabuto and Den-O.

    that post was about how odex lost the case against PacNet and how the Youth Park meeting actually took place, despite the fact that the it was initially canceled.

    But dont celebrate too early yet. We still dont know whats gonna happen in ODEX’s appeal case. We all know how Sg courts and Sg govt work dont we?

    If ODEX wins the appeal, it might just set a precedent for more distributors of movies/TV shows to follow suit and they WE WILL ALL be in deepshit!

    If ODEX’s appeal is thrown out, then sg net users will reign free in the virtual world, free to dl as much as we like via torrents.

    If they had a choice in this…. who do you think the authorities would side?
